Terms of Service

1. Acceptance of Terms

By accessing or using YourVPN ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. You must be at least 18 years old to use this Service.

2. Description of Service

YourVPN provides virtual private network (VPN) services that allow users to route their internet traffic through our servers. The Service functions as a conduit for data transmission and does not monitor, filter, or modify the content of user traffic. The Service includes access to our VPN servers, a personal access key, and customer support.

3. Account Registration

To use the Service, you must provide a valid email address and payment information. You are responsible for maintaining the confidentiality of your VPN access key and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

4. Subscription and Billing

• The Service is billed at $2.00 USD per week on a recurring basis.
• Billing occurs automatically each week until you cancel.
• You may cancel your subscription at any time through your Stripe billing portal or by contacting us.
• Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial weeks.

5. Prohibited Activities

You agree NOT to use the Service for any of the following prohibited activities:

• Copyright Infringement: Downloading, uploading, sharing, or distributing copyrighted content (including but not limited to movies, music, software, games, books) without authorization from the copyright holder
• Illegal File Sharing: Using peer-to-peer networks or torrent services to share copyrighted material
• Distribution of Illegal Content: Transmitting child sexual abuse material (CSAM), content depicting violence, or any material illegal under applicable law
• Hacking & Unauthorized Access: Attempting to gain unauthorized access to computer systems, networks, or data
• Malware Distribution: Spreading viruses, trojans, ransomware, or other malicious software
• Spam & Phishing: Sending unsolicited communications or attempting to deceive others to obtain personal information
• Fraud: Engaging in fraudulent activities, identity theft, or financial crimes
• Harassment: Stalking, threatening, or harassing others
• Terrorism: Any activity that supports or facilitates terrorism
• DDoS Attacks: Launching denial-of-service attacks against any target
• Resale: Sharing your access key publicly or reselling access to the Service

Violation of these terms will result in immediate termination of your account without refund.

6. User Responsibility

You acknowledge and agree that:

• You are solely responsible for your use of the Service and any content you transmit
• You will comply with all applicable local, state, national, and international laws and regulations
• You will not use the Service for any purpose that is illegal in your jurisdiction or ours
• The Service is provided for legitimate privacy protection purposes only
• Using a VPN does not grant immunity from legal consequences of illegal activities

7. DMCA Policy & Copyright Complaints

YourVPN respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA).

Notification of Infringement

If you believe that your copyrighted work has been infringed through our Service, please send a DMCA notice to our designated agent with the following information:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to be infringed
• Identification of the material claimed to be infringing, with reasonably sufficient information to locate it
• Your contact information (address, phone number, email)
• A statement that you have a good faith belief that use of the material is not authorized
• A statement, under penalty of perjury, that the information in the notice is accurate

DMCA Agent

Repeat Infringer Policy

We will terminate the accounts of users who are repeat infringers of copyright. Upon receiving valid DMCA notices, we will take appropriate action, which may include account suspension or termination.

8. Bandwidth Limits

Each subscription includes 50GB of bandwidth per week. Bandwidth resets at the start of each billing period. If you exceed your bandwidth limit, your connection may be throttled or temporarily suspended until the next billing period.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

10. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or refund, for:

• Violation of these Terms, including prohibited activities
• Receipt of valid DMCA notices or other legal complaints
• Suspected fraudulent, abusive, or illegal activity
• Any other reason at our sole discretion

11. Indemnification

You agree to indemnify, defend, and hold harmless YourVPN, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you transmit through the Service
• Any illegal activity conducted using the Service

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE SERVICE WILL PROTECT YOU FROM LEGAL CONSEQUENCES OF YOUR OWN ACTIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL YOURVPN, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST THREE (3) MONTHS.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
